"Following the Planning and Infrastructure portfolio holder's (Cllr Sherlock BDBC) statement calling-in DDN 794/PL, previously supported by the Parish Council, Draft Decision Notice (DDN) 883/PL has been published. The most significant difference between the two notices is that DDN 794/PL made no reference to the allocation of 200 homes to the Village environs, whereas DD883/PL requests that Planning officers and the P&I Scrutiny Committee further investigate the capacity of a number of sites to accommodate "growth". Included in these sites is Bramley with a "Neighbourhood plan yield" of 200 homes. We are not exactly sure exactly what this means and will be seeking clarification from BDBC. This does not mean Bramley has received an allocation, but rather that further investigation is required."

 

Statement by Portfolio Holder

In the light of the adjournment of the Call-in hearing of the Planning and Infrastructure committee last week until the 15th of April, and with no certainty that the hearing will be completed on that date, I am concerned that the process of developing the Local Plan may be delayed so that it cannot come to Council in July for agreement on the draft for consultation.

Progress on the Local Plan is vital to ensure that we have in place the necessary planning protections as soon as possible. Should a Local Plan not be in place by April 2014 then the Council will cease to be able to collect pooled contributions towards infrastructure from more than 5 developments, and will not have a Community Infrastructure Levy Charging Schedule in place to enable it to collect CIL payments from new developments. Likewise, while the Council does not have a 5 year housing land supply (and it is unlikely to until the Local Plan is in place), there is the continuing threat of planning by appeal.

I consider it a priority to remove any barriers in the way of adoption of the Local Plan within the required timeframe. I am therefore withdrawing the Decision Notice no 794/PL and Cabinet will meet as soon as possible to consider a revised decision that will permit the necessary work to go forward without delay.

The decision which is being withdrawn identified sites for further evaluation. It did not determine a definitive list for inclusion in the Local Plan. The housing number is still only provisional, pending publication of further government data and subsequent analysis. This analysis, and the further evaluation of infrastructure and environmental requirements for sites, is due to be reported to Planning and Infrastructure Committee to enable them to make appropriate recommendations. I consider it most important that the work necessary to fully inform those recommendations should continue without any unnecessary impediments that could potentially be caused by the call-in process.

THE DECISION IS THAT:

  1. i)Cabinet notes the report, particularly taking account of:
    1. a)the results of the site assessment work and sustainability appraisal that have been undertaken;
    2. b)the approach to distributing development and the suggested sites and locations for development;
    3. c)the comments of the Planning and Infrastructure Overview and Scrutiny Committee of 17, 21 and 31 January, those of the public and Officer responses, as set out in the Supplementary Report; and
    4. d)the concerns of the Planning and Infrastructure Committee with regard to the need for a comprehensive infrastructure assessment to accompany individual site assessments before a final decision on site selection is made, and in particular the cumulative impact of sites in local areas
  2. ii)Cabinet notes that the housing number is not yet agreed and is a provisional working hypothesis. The result of further work following the meeting of Planning and Infrastructure Committee on the 19 March will be reported back to the committee before comments are made on this by the committee to the portfolio holder for Planning.
  3. iii)In this context Cabinet notes the suggested sites for development identified in the table under Paragraph 6.58 (of the main report) in conjunction with the supplementary report of the 28th February and listed below, and agrees they should be subject to further infrastructure and environmental assessment, along with other category 1 sites that may be required as additions, alternatives or replacements as appropriate once this evaluation has been completed and the final housing number has been agreed. This work will be reported to Planning and Infrastructure Committee for the committee to recommend to the portfolio holder for Planning a list of sites for inclusion in the Borough Council’s emerging Local Plan.

  1. iv)Cabinet requests Officers to review existing infrastructure and environmental assessments for the above list of sites, when considered in addition to undeveloped sites with existing planning permission and/or Local Plan allocation, and undertake an appropriate evaluationindividual infrastructure requirements and the potential strategic infrastructure and cumulative impacts of the above development, prior to a final determination of the sites to be included in the Borough Council’s emerging Local Plan ;
  2. v)Cabinet requests Officers undertake further work with relevant landowners or their representatives, and service providers, to consider how best to mitigate any strategic infrastructure issues, including further work on the cumulative transport impacts which may arise from the suggested sites;
  3. vi)Cabinet requests Officers to make further enquiries of the Planning Inspectorate to determine the robustness of the inclusion of future, as yet undelivered, Neighbourhood Plans where alternative category 1 sites are available or, where no category 1 sites are available, of emerging Neighbourhood Plans as suitable for allocation with specific housing numbers;
  4. vii)Cabinet notes thenumber allocations identified in the table under Paragraph 6.58 (of the main report) in conjunction with the supplementary report of the 28th February as set out in the table below, and seeks testing of this approach, in line with (vi) and through  infrastructure and environmental assessments in line with (iv), to confirm the capacity of these settlements to accommodate growth and to what level;

This work will be reported to Planning and Infrastructure Committee for the committee to recommend to the portfolio holder for Planning whether and how these settlements should be included in the Borough Council’s emerging Local Plan.

  1. viii)Cabinet endorses the approaches outlined in paragraphs 6.60 in respect of meeting any future shortfall and agrees that officers carry out a comprehensive Settlement Policy Boundary review following adoption of the plan, in addition to further SPBs (as referred to in paragraph 6.55 of the report.);
    1. ix)In accordance with the comments from Planning and Infrastructure Committee, Cabinet requests Officers to give particular consideration to the potential requirement during and beyond the plan period for (a) a road through Manydown linking the A30/M3 Junction 7 and the A339; and (b) any improvements required to the A30, A33, A339, A340 and B3400;
    2. x)Cabinet agrees that for planning purposes the area for masterplanning (around Manydown) is extended to include the Worting area, as shown on the map on appendix 2 of the supplementary report, with additional highlighting for masterplanning of the site for planning purposes beyond the local plan period;
    3. xi)Cabinet agrees that the Borough Council should, in 2020, give consideration to carrying out a review to evaluate the likely delivery of the Local Plan and, if necessary, to identify any new sites that may be required to support delivery over the remainder of the Local Plan period; and
    4. xii)Cabinet agrees that the Pre-Submission Local Plan will be considered by Council prior to undertaking public consultation later this year.

 

THE REASONS FOR THE DECISION ARE:

  • To enable the Council to progress work on the Local Plan, to ensure that the Council maintains a future supply of deliverable housing sites.
  • No overall recommendations on preferred sites were made by Planning and Infrastructure Committee.

THE OPTIONS CONSIDERED AND REJECTED ARE:

  • To not progress the Local Plan
  • To progress the other distribution options considered in the Officer report
